The information we collect depends on whether you use Zegacy as a prospective tenant-buyer, investor, property owner, business partner, or other participant.

B. Tenant-Buyer and Qualification Information

- Available funds and proof-of-funds documentation
- Current rent or housing expenses
- Assets, liabilities, debts, and recurring obligations

- Intended option payment or other funds available for a transaction

- Household information relevant to a potential lease

A budget, match score, preliminary assessment, or similar result may be based on self-reported information and is not a mortgage approval, commitment to lend, guarantee of investor interest, or guarantee that you will receive or purchase a home.

Zegacy generally does not directly retain complete payment-card numbers when payments are processed by a third-party payment processor.

A. Tenant-Buyers, Investors, and Property Owners
To provide the marketplace, we may disclose information between prospective transaction participants.
For example:
- Investors may receive property information and a summarized tenant-buyer profile, including relevant income, available funds, proposed option payment, timeline, and financial readiness.
- Tenant-buyers may receive information about an investor, property owner, property, and proposed transaction terms.
Additional documents or identifying information may be disclosed when reasonably necessary to evaluate, negotiate, document, or complete a transaction.
Users receiving another person’s information may use it only to evaluate or complete an authorized Zegacy transaction and must protect it from unauthorized use or disclosure.
B. Transaction and Professional Service Providers
We may disclose information to:
- Real estate agents and brokers
- Lenders and loan originators
- Title, escrow, and closing providers
- Attorneys and accountants
- Property inspectors and appraisers
- Insurance providers
- Property managers and servicing providers
- Contractors involved in a property or transaction
- Electronic-signature and document-preparation providers
Zegacy may share your contact and application information with Heartland Credit Restoration so it may contact you regarding optional credit education or credit restoration services. You are under no obligation to speak with, enroll with, or purchase services from Heartland. Heartland operates independently from Zegacy, and Zegacy may receive compensation if you choose to enroll in a paid program.
These providers operate under their own agreements and privacy practices.
C. Technology and Business Providers
We may disclose information to providers that support:
- Website hosting and software infrastructure
- Cloud storage and document management
- Customer relationship management
- Email, telephone, and text communications
- Payment processing
- Accounting and recordkeeping

5. Advertising, Sale, and Targeted Advertising
Zegacy does not sell personal information for money.
We may disclose online identifiers, website activity, advertising attribution information, and similar information to analytics and advertising providers. Certain state laws may define some of these activities as “sharing,” “sale,” or “targeted advertising,” even when no money is exchanged.
Where applicable, you may request to opt out by emailing Founders@zegacy.com with the subject line Privacy Opt-Out.
Information intentionally disclosed to investors, tenants, property owners, or service providers to fulfill your request or facilitate a transaction is not treated by Zegacy as the sale of personal information.
We do not knowingly use sensitive financial documents, credit information, government identification numbers, or banking documents for targeted advertising.
6. Consumer Reports and Screening Information
Zegacy or a transaction participant may request a credit report, tenant-screening report, background report, identity-verification report, or other consumer report.
When a separate authorization, disclosure, permissible purpose, or adverse-action notice is legally required, it will be handled separately from these general website terms.
Agreeing to this Privacy Policy alone does not constitute authorization for every possible credit or background check.
8. Data Security
We use administrative, technical, and physical safeguards designed to protect personal information based on the nature and sensitivity of the information involved.
No electronic transmission, storage system, or security measure can guarantee complete security. You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly of suspected unauthorized account activity.

We retain information for as long as reasonably necessary to:

- Provide the Services
- Evaluate or complete a transaction
- Administer an ongoing lease-option or servicing relationship
- Resolve disputes

Retention periods depend on the type of information, whether a transaction was completed, applicable legal requirements, and the continuing need for the information.
We may retain deidentified or aggregated information that can no longer reasonably identify you.

11. Communication Choices
You may unsubscribe from marketing emails using the link in the message.
You may opt out of marketing text messages by replying STOP.
We may continue sending non-marketing communications concerning:
- Your account
- A requested service
- Document requirements
- Security notices
- Payment or transaction activity
- A pending or completed transaction
- Changes to agreements or legally required notices
Consent to receive marketing communications is not a condition of purchasing a Zegacy service unless clearly stated otherwise and legally permitted.
12. Children and Eligibility
The Services are intended for adults who are at least 18 years old.
We do not knowingly collect personal information from children under 13. A parent or guardian who believes a child has provided personal information should contact us so we can investigate and take appropriate action.

Zegacy is not responsible for the privacy, security, content, or practices of third parties. Review their terms and privacy policies before providing information.

The Services are directed primarily to users and properties in the United States. Information may be processed and stored in the United States and other locations where our service providers operate, subject to applicable law.

We may update this Privacy Policy as our Services, business practices, or legal obligations change.
