Zegacy, Inc., doing business as Zegacy (“Zegacy,” “we,” “us,” or “our”), operates a technology-enabled marketplace that connects prospective tenant-buyers, real estate investors, property owners, and transaction service providers in connection with potential rent-to-own and lease-option transactions.
This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit Zegacy.com, create an account, submit an application, upload documents, communicate with us, review an opportunity, submit a proposal, participate in a transaction, or otherwise use our websites, applications, communications, and services collectively referred to as the “Services.”
By using the Services, you acknowledge the practices described in this Privacy Policy.
1. Personal Information We Collect
The information we collect depends on whether you use Zegacy as a prospective tenant-buyer, investor, property owner, business partner, or other participant.
A. Contact and Account Information

- Communication preferences
- Business name and title
- Information about other adult household members or authorized representatives
B. Tenant-Buyer and Qualification Information
When you request an assessment, become verified, or pursue a transaction, we may collect:

- Pay stubs, tax returns, bank statements, or other income documentation
- Available funds and proof-of-funds documentation
- Current rent or housing expenses
- Assets, liabilities, debts, and recurring obligations
- Credit-related information you provide
- Housing and rental history
- Desired property, location, timeline, and purchase budget
- Intended option payment or other funds available for a transaction
- Identification documents
- Household information relevant to a potential lease
- Information about your expected ability and timeline to obtain financing

A budget, match score, preliminary assessment, or similar result may be based on self-reported information and is not a mortgage approval, commitment to lend, guarantee of investor interest, or guarantee that you will receive or purchase a home.

- Target markets, property types, and investment criteria

Zegacy generally does not directly retain complete payment-card numbers when payments are processed by a third-party payment processor.

- Investor or tenant compatibility
- Potential transaction risks
- Fraud or identity-verification risk
These assessments may involve formulas, rules, or software-assisted processes. They are informational and do not guarantee an outcome.
I. Sensitive Personal Information
Certain information we collect may be considered “sensitive personal information” or “sensitive data” under applicable law, including government-issued identification, financial account information, income and financial documentation, credit-related information, and account credentials. We use sensitive personal information only as reasonably necessary to provide requested Services, verify identity and submitted information, evaluate or facilitate transactions, prevent fraud, maintain security, and comply with legal obligations. Where applicable law requires consent or provides additional rights relating to sensitive personal information, we will honor those requirements.

A. Tenant-Buyers, Investors, and Property Owners
To provide the marketplace, we may disclose information between prospective transaction participants.
For example:
- Investors may receive property information and a summarized tenant-buyer profile, including relevant income, available funds, proposed option payment, timeline, and financial readiness.
- Tenant-buyers may receive information about an investor, property owner, property, and proposed transaction terms.
- Additional documents or identifying information may be disclosed when reasonably necessary to evaluate, negotiate, document, or complete a transaction.
Users receiving another person’s information may use it only to evaluate or complete an authorized Zegacy transaction and must protect it from unauthorized use or disclosure.
B. Transaction, Referral, and Professional Service Providers
We may disclose information to:
- Real estate agents and brokers
- Lenders and loan originators
- Title, escrow, and closing providers
- Attorneys and accountants
- Property inspectors and appraisers
- Insurance providers
- Property managers and servicing providers
- Contractors involved in a property or transaction
- Electronic-signature and document-preparation providers
- Credit education, credit restoration, and other referral partners
Zegacy may share your contact information and relevant application information with Heartland Credit Restoration so that Heartland may contact you regarding optional credit education or credit restoration services. You are under no obligation to speak with, enroll with, or purchase services from Heartland. Heartland operates independently from Zegacy. Zegacy may receive compensation if you choose to enroll in a paid Heartland program. Where required by applicable law, Zegacy will obtain any consent required before making such a referral.
These providers operate under their own agreements and privacy practices.
C. Technology and Business Providers
We may disclose information to providers that support:
- Website hosting and software infrastructure
- Cloud storage and document management
- Customer relationship management
- Email, telephone, and text communications
- Payment processing
- Accounting and recordkeeping
- Analytics and advertising measurement
- Identity verification and fraud prevention

5. Advertising, Sale, Sharing, and Targeted Advertising
Zegacy does not sell personal information to data brokers for their independent marketing. However, we may disclose personal information to referral partners, advertising and analytics providers, investors, and other third parties as described in this Privacy Policy. Depending on the applicable state law and the circumstances, some of these disclosures may be considered a “sale,” “sharing,” or use for “targeted advertising,” even when Zegacy is not paid specifically for the personal information.
We may disclose online identifiers, website activity, advertising attribution information, and similar information to analytics and advertising providers. Certain state laws may define some of these activities as “sharing,” “sale,” or “targeted advertising,” even when no money is exchanged.

Information intentionally disclosed to investors, tenants, property owners, or service providers to fulfill your request or facilitate a transaction may be treated differently under applicable law depending on the purpose and circumstances of the disclosure.
We do not knowingly use sensitive financial documents, credit information, government identification numbers, banking documents, or uploaded-document contents for targeted advertising.
6. Consumer Reports and Screening Information
Zegacy or a transaction participant may request a credit report, tenant-screening report, background report, identity-verification report, or other consumer report.
When a separate authorization, disclosure, permissible purpose, or adverse-action notice is legally required, it will be handled separately from these general website terms.
Agreeing to this Privacy Policy alone does not constitute authorization for every possible credit or background check.
8. Data Security
We use administrative, technical, and physical safeguards designed to protect personal information based on the nature and sensitivity of the information involved.
No electronic transmission, storage system, or security measure can guarantee complete security. You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly of suspected unauthorized account activity.
9. Data Retention
We retain information for as long as reasonably necessary to:
- Maintain your account
- Provide the Services
- Evaluate or complete a transaction
- Administer an ongoing lease-option or servicing relationship
- Resolve disputes
- Prevent fraud
- Enforce agreements
- Meet tax, accounting, regulatory, insurance, or legal obligations
Retention periods depend on the type of information, whether a transaction was completed, applicable legal requirements, and the continuing need for the information.
We may retain deidentified or aggregated information that can no longer reasonably identify you.

The rights described in this section apply only where an applicable privacy law grants the right and applies to Zegacy’s processing of your personal information. Rights, exceptions, and applicability thresholds vary by state.
Depending on applicable law, you may have the right to:
- Confirm whether we process your personal information
- Request access to personal information
- Request correction of inaccurate information
- Request deletion of certain information
- Receive certain information in a portable format
- Opt out of qualifying sales, sharing, or targeted advertising
- Opt out of certain qualifying profiling activities
- Limit certain uses of sensitive personal information
- Appeal the denial of a privacy request
- Receive equal service without unlawful discrimination for exercising a privacy right

Please provide enough information for us to identify your account and understand your request. We may verify your identity before responding. An authorized agent may submit a request when permitted by law, but we may require proof of the agent’s authority and verification of the consumer’s identity.
Some information may be exempt from a request, including information we must retain for legal, security, fraud-prevention, or transaction-record purposes.
If applicable law provides a right to appeal and we deny your privacy request, you may appeal by emailing Founders@zegacy.com with the subject line Privacy Appeal. We will review and respond to the appeal as required by applicable law.
A. Connecticut Residents
If Zegacy collects or processes sensitive data from a Connecticut resident and Connecticut law applies to that processing, Zegacy will comply with applicable consent, notice, withdrawal, and consumer-rights requirements. Sensitive data may include government-issued identification and other information treated as sensitive under applicable law.
B. Other State-Specific Rights
Residents of California, Delaware, Nevada, and other states may have additional privacy rights or disclosures available under laws applicable to website operators or businesses processing personal information. Where such laws apply to Zegacy, we will honor applicable rights and required disclosures. You may contact us using the information in Section 16 with questions or requests.
11. Communication Choices
You may unsubscribe from marketing emails using the link in the message.
You may opt out of marketing text messages by replying STOP.
We may continue sending non-marketing communications concerning:
- Your account
- A requested service
- Document requirements
- Security notices
- Payment or transaction activity
- A pending or completed transaction
- Changes to agreements or legally required notices
Consent to receive marketing communications is not a condition of purchasing a Zegacy service unless clearly stated otherwise and legally permitted.
12. Children and Eligibility
The Services are intended for adults who are at least 18 years old.
We do not knowingly collect personal information from children under 13. A parent or guardian who believes a child has provided personal information should contact us so we can investigate and take appropriate action.
13. Third-Party Websites and Services
Our Services may contain links to property listings, lenders, agents, payment processors, credit restoration providers, and other third-party websites or services.
Zegacy is not responsible for the privacy, security, content, or practices of third parties. Review their terms and privacy policies before providing information.
14. United States Operations
The Services are directed to users and properties in the United States and are not intentionally marketed to individuals outside the United States. Information may be processed and stored in the United States and other locations where our service providers operate, subject to applicable law.
If Zegacy begins offering Services in other jurisdictions, additional privacy notices or rights may apply.
15. Changes to This Privacy Policy
We may update this Privacy Policy as our Services, business practices, or legal obligations change.
We will post the revised policy with an updated effective date. When legally required or when a change is material, we may provide additional notice through the Services or by email.
